Texas solar disclosures: what changes on November 1, 2026?

By Mass AI · Reviewed

Current Texas rules and TDLR guidance checked October 23, 2026. General information, not legal advice.

TDLR says its temporary enforcement suspension for §§71.41 and 71.43 lasts until November 1, 2026. Those sections cover contract disclosures and educational materials. November 1 is not a new registration deadline.

This is a focused paperwork guide for Texas residential solar retail transactions, not every Chapter 71 duty. The rules assign duties to retailers and salespersons. Check your role, transaction and any exemptions in the current laws and rules before applying the checklist.

Keep the three dates separate

  • July 1, 2026: formal rule effective date.

The source notes in §71.41 and §71.43 identify this effective date.

  • September 1, 2026: registration requirement.

TDLR's timing guidance says residential solar retailers and salespersons must be registered from this date to conduct the covered sales or leases.

  • November 1, 2026: the two-section enforcement suspension.

TDLR's notice addresses enforcement of §§71.41 and 71.43. It does not postpone every contract or cancellation duty.

Five disclosure and brochure checks

Review the required action and who must take it. A document in a deal folder does not, by itself, establish when it was delivered or signed.

Duties in Texas disclosure and educational-material rules
CheckRequired actionRule
Completed disclosure before signingThe salesperson provides the approved form with all required information before the consumer may sign. Use the consumer's preferred language when TDLR has an approved version.§71.41(a)
Both signatures before executionThe consumer and the solar salesperson sign the disclosure before the solar contract is executed.§71.41(b)
Accurate termsThe salesperson and retailer ensure the disclosure is true and matches the contract. Its terms become part of that contract.§71.41(c)–(d)
Printed copy when requiredThe salesperson provides a completed printed form for a consumer aged 65 or older at the transaction, or one who indicates they are not fluent in English. Other electronic delivery must meet §71.40.§71.41(e)
Brochure at least 24 hours before signingThe salesperson gives the consumer TDLR's approved educational brochure at least 24 hours before the consumer may sign the solar contract.§71.43(b)

Use the official forms and instructions

TDLR Forms and Publications provides the consumer disclosure form, its instructions, and the educational brochure, including available Spanish versions. Use that page to find the agency's current files rather than an old copy from a deal folder.

Give a reviewer the contract, completed disclosure, brochure version and available delivery or signing evidence. Resolve missing or conflicting evidence before treating the paperwork as ready. This is a suggested internal review process, not an additional legal requirement or proof of compliance.

Texas solar paperwork questions

Is November 1, 2026 a new solar registration deadline?

No. TDLR's November 1 notice concerns its temporary suspension of enforcement for §§71.41 and 71.43. The agency's registration requirement began September 1, 2026 for covered retailers and salespersons.

When must the consumer receive the educational brochure?

Under §71.43(b), the solar salesperson provides TDLR's approved brochure at least 24 hours before the consumer may sign the solar contract.

Does the disclosure replace the solar contract?

No. The disclosure records key terms. Section 71.41(c) requires accurate information that reflects the contract, and subsection (d) makes those disclosure terms part of the contract.

Does a form in the deal file prove compliance?

No. Review who completed and signed it, the applicable delivery conditions and the evidence of timing. This guide covers two rule sections; it is not a complete Chapter 71 compliance review.
